Terms and Conditions

1. Scope, definitions

Final Escape 2.10 GmbH (hereinafter: “Final Escape”), Warnowufer 60, 18057 Rostock, offers services and products in the areas of escape games and city rallies to interested persons (hereinafter: “Customer”). The following Terms and Conditions govern, conclusively and exclusively, the conclusion of the contract and its performance.

2. Subject matter of the contract

2.1 The subject matter of the contract is the provision of the leisure events offered. Final Escape offers leisure activities for groups of between 2 and 200 people in the areas of escape games and city rallies. The minimum age for booking customers is 16. The participant group for the leisure event may also include younger participants. Under-14s must be accompanied to the venue on the day of the event by an adult. The aim of the leisure activities is to solve tasks and puzzles together as a team. The leisure experiences have a fixed duration, which is communicated during the booking process. In the case of escape games, the venue is a room set up specifically for this purpose, which can be booked exclusively for your group. In the case of city rallies, the venue is a defined route in public space that the group explores independently. No prior knowledge or special physical attributes (e.g., height or strength) are required to solve the puzzles—only brains and dexterity. If needed, the group will receive targeted assistance from game masters.

2.2 The subject matter of the contract may also include group events. Group events exist when customers book three or more games with the same start time.

2.3 The leisure event starts punctually at the start time and location stated in the booking confirmation. Final Escape recommends arriving on site 15 minutes before the event begins. If you arrive late, the agreed service cannot be provided and the event cannot take place. There is no entitlement to a refund.

3. Formation of the contract

Registration for the game can be made via the website, by phone, or by email.

3.1 Via the Final Escape website (www.final-escape.com), escape games and city rallies are offered for booking, as well as multi-purpose vouchers for these leisure activities. The presentation and promotion of the various leisure activities does not constitute a binding offer to conclude a contract. The customer can choose from the events offered. Available dates are shown in the calendar view provided. By confirming the “Book” button, the customer registers bindingly for the game within the booked period and desired time slot. To book the event, Final Escape first requests data such as the customer’s name, email address, phone number and, if applicable, billing address. By clicking the “Place order with obligation to pay” button, the customer submits a binding offer to conclude a contract. Before submitting the booking, the customer can review and change their entries at any time. The customer can print and save the Terms and Conditions (terms of use) via their browser. After the order is submitted, Final Escape sends the customer a booking confirmation by email. The contract is concluded upon this booking confirmation. The booking confirmation must be checked by the customer without delay; any errors must be reported to Final Escape.

If the customer has ordered a multi-purpose voucher, the voucher code will be provided in the booking confirmation email. This entitles the customer, or a person to whom the customer passes on the multi-purpose voucher, to use the voucher amount as a means of payment when booking escape games and city rallies and when paying on site for the game.

Input errors can be corrected using the usual keyboard, mouse and browser functions (e.g., the browser’s “Back” button). A selected appointment is reserved for 15 minutes and will be released for booking again if the booking is not completed.

3.2 When booking by phone, the customer can also choose from the events offered. To book, the customer must provide the required information by phone. The customer can print and save the Terms and Conditions via their browser. After the phone booking, Final Escape sends the customer a booking confirmation by email, in which the customer’s booking and personal data are listed again. The contract is concluded upon this booking confirmation. The booking confirmation must be checked by the customer without delay; any errors must be reported to Final Escape.

3.3 When booking by email, the Customer chooses from the available events. To book, the Customer must provide the required information by email. The Customer can print and save the Terms and Conditions via their browser. After booking, Final Escape will send the Customer a booking confirmation by email, which again lists the Customer’s booking and personal details. The contract is concluded with this booking confirmation. The booking confirmation must be checked by the Customer without delay; any errors must be reported to Final Escape.

3.4 If a contract is concluded, it is concluded with: Final Escape 2.10 GmbH, Warnowufer 60, 18057 Rostock.

4. Cancellation, no-show, booking changes, refunds

4.1 Cancellation of a booking is free of charge up to 48 hours before the day of the game. If a booked leisure event is cancelled later or not attended, the full invoice amount becomes due for payment immediately.

4.2 Changes to a booking, e.g., the number of participants or the date, are possible free of charge before the cancellation deadline—subject to availability. The amended booking is only legally binding once a new booking confirmation has been issued.

4.3 Payments already made will be refunded via the selected payment method.

4.4 Group events pursuant to clause 2.2 of the Terms and Conditions are excluded from the provisions in sections 4.1, 4.2 and 4.3. After a binding booking and receipt of the booking confirmation, the customer has no entitlement to cancel individual persons, receive a refund, or reschedule the dates.

5. Fees, payment terms

The fee depends on the size of the group and the booked time. The amount is shown during the ordering process and includes statutory VAT. The amount becomes due for payment upon booking confirmation.

Payment must be made online via PayPal, credit card, Sofortüberweisung, GiroPay, or on site at the start of the event by debit card/credit card.

Group events pursuant to clause 2.2 will receive a pro forma invoice, which is due immediately and must be paid by bank transfer.

6. Vouchers

6.1 The vouchers sold by us via our online shop are multi-purpose vouchers. They can be used by their respective holder to redeem services under the conditions applicable at the time the voucher is redeemed.

6.2 Due date

Payment of the purchase price in the amount of the selected multi-purpose voucher, including statutory VAT, is due immediately upon conclusion of the contract.

6.3 Redeeming the voucher

(1) The multi-purpose voucher entitles the user to use the voucher in the amount of its face value to redeem services from Final Escape.

(2) If the price of the service to be provided by Final Escape that is paid for with a multi-purpose voucher is lower than the face value of the multi-purpose voucher used as a means of payment, the difference remains as credit for the user.

(3) Cash payment of the difference is excluded, and the redemption period of the multi-purpose voucher used as a means of payment remains applicable.

(4) If the price of the service is higher than the face value of the multi-purpose voucher, the user must pay the difference.

(5) Multi-purpose vouchers issued by Final Escape expire one year after the end of the calendar year.

(6) Promotional vouchers (vouchers that can only be purchased for a limited period and are designated as promotional vouchers) cannot be redeemed for group events pursuant to clause 2.2 of the Terms and Conditions.

(7) Discount codes cannot be redeemed for group events pursuant to clause 2.2 of the Terms and Conditions.

6.4 Prices

(1) The stated price for the multi-purpose voucher is binding and includes statutory VAT in each case.

(2) All stated prices are total prices.

6.5 Payment process and delivery

(1) The purchased multi-purpose voucher is paid for by the user in the online shop using the selected payment method.

(2) To make payments in this way, an account with the respective payment service provider is required. This may require the user to register separately with the payment service provider.

(3) During the payment process, the user is redirected to the website of the respective payment provider; the provider’s respective business and terms of use apply there.

(4) The user receives the multi-purpose voucher by email.

(5) Multi-purpose vouchers can be redeemed at all Final Escape locations.

7. Liability

Subject to the following exceptions, Final Escape’s liability for breaches of contractual obligations and for tort is limited to intent or gross negligence.

In cases of slight negligence, Final Escape is liable without limitation in the event of injury to life, body or health, or in the event of a breach of an essential contractual obligation. If Final Escape is in default due to slight negligence, if performance has become impossible, or if Final Escape has breached an essential contractual obligation, liability for resulting property damage and financial loss is limited to the foreseeable damage typical for the contract. An essential contractual obligation is one whose fulfilment makes the proper performance of the contract possible in the first place, whose breach jeopardizes the achievement of the contract’s purpose, and on whose compliance the customer may regularly rely. This includes, in particular, the obligation to act and to provide the contractually owed service described in clause 2.

Final Escape is not liable for lost coats or for lost or missing valuables. Final Escape assumes no duty of care in this respect. Final Escape also assumes no liability for items of clothing that are damaged during the leisure activities.

We also point out that the existing premises may contain technical equipment such as 12V magnets, flickering light and natural products, which may trigger symptoms of illnesses such as epilepsy or allergies. Final Escape assumes no liability for this.

8. Notes on data protection and data processing

8.1 In the course of processing contracts, Final Escape collects customer data. In doing so, Final Escape complies in particular with the provisions of the Federal Data Protection Act (Bundesdatenschutzgesetz) and the Telemedia Act (Telemediengesetz). Without the customer’s consent—e.g., in accordance with any data usage declaration provided by the customer (hereinafter “DNE”)—Final Escape will only collect, store, process or use the customer’s personal data insofar as this is necessary for handling the contractual relationship and for the use and billing of telemedia services.

8.2 Final Escape and/or the authorized third-party ticket seller Belbo Business Software GmbH are connected to Final Escape’s central billing system. The data collected is stored on Final Escape’s central server only in accordance with any DNE granted and in strict compliance with the applicable statutory provisions.

8.3 With regard to personal and usage-specific data, the customer has the rights to information, correction and deletion guaranteed by the Federal Data Protection Act; these rights may be exercised by sending a message by post (contact details under clause 1) or by email to hq@final-escape.de.

9. Prohibited customer conduct

9.1 All events in the premises, as well as the premises themselves, are protected works pursuant to Section 2 of the Copyright Act (Urheberrechtsgesetz). Taking photographs and making film, video or audio recordings are prohibited. In the event of an unauthorized recording of an event or parts of an event, Final Escape will file a criminal complaint with the law enforcement authorities.

9.2 Bringing food and drinks into the event room, as well as consuming food and drinks brought along anywhere on the event premises, is not permitted.

9.3 Smoking is prohibited in all areas of the venue.

9.4 Final Escape may refuse a customer entry to the venue if there is reason to fear that the person concerned, due to alcohol or drug consumption or for other reasons, will disrupt the performance or general business operations or harass other visitors.

9.5 Animals must stay outside.

10. Removal from the premises and ban from the premises

In the event of violations of the above provisions in sections 8 and 9, Final Escape is entitled to remove the respective visitor from the premises. Without prejudice to its other rights, Final Escape is entitled, in the event of significant or repeated disruption and in the case of violations of these provisions, to impose a temporary or permanent ban from the premises in individual cases.

11. Required customer conduct

11.1 For the duration of their stay at the venue, the customer undertakes to use the premises with due care, in particular the furnishings and inventory of the game rooms. In the event of any culpable damage, Final Escape reserves the right to pursue civil claims and, in the case of intentional damage, also criminal prosecution.

11.2 Items of any kind found at the venue must be handed in to staff.

11.3 The customer undertakes to follow the instructions of Final Escape staff and to refrain from disrupting operations of any kind. Mobile phones and other electronic communication devices, as well as acoustic signaling devices of any kind, are not permitted in the game rooms. The use of optical pointing devices (laser pointers) is prohibited. In the interest of an undisturbed event, Final Escape is entitled to request the user of one of the aforementioned devices to switch it off immediately or to ask the customer to leave the event.

12. Audio, photo and film recordings

12.1. Audio, photo and film recordings are prohibited throughout the entire premises of Final Escape for copyright reasons. This applies regardless of the type of device used to make the recordings. In the event of violations of the recording ban, a contractual penalty becomes due without prejudice to further claims; the amount is to be determined by Final Escape at its reasonable discretion, but no more than EUR 5,000.00 per individual case. Recording devices and cameras of any kind may not be taken into the puzzle rooms. They must be handed in at the cloakroom for safekeeping.

12.2. In the event of violations, venue staff are entitled to confiscate recording devices and cameras and retain them until the end of the event. Films and recording materials of any kind on which parts of the event are recorded may be confiscated and kept by Final Escape. They will be returned to the owner once the owner has agreed to the deletion of the recordings and the deletion has been carried out.

12.3. Final Escape is entitled, within the scope of events, to reproduce, broadcast or have created, and to use or have used in audiovisual media, audio/photo and film recordings of the customer and their companions that go beyond the depiction of a current event (right to one’s own image). Consent is expressly given with a waiver of any claim to remuneration.

13. Trade secrets

The solutions in the puzzle rooms are trade secrets of Final Escape and may not be disclosed to third parties. In the event of a violation, Final Escape will take legal action against the responsible party and assert all damages against them.

14. Image and camera recordings during the leisure activities

The customer agrees that they will be monitored by the game masters via a screen during the leisure activities. This serves the customers’ safety. The recordings are not stored.

We also point out that surveillance cameras are installed in the entrance and lounge areas.

The surveillance cameras are intended to avert risks to the company and its employees that may arise if unauthorized persons gain access to the locations. Video surveillance is intended in particular for theft prevention and the protection of employees.

15. Applicable law and place of jurisdiction

Only the law of the Federal Republic of Germany applies.

If the Customer is a merchant and has their registered office in Germany at the time of booking, the exclusive place of jurisdiction is the registered office of Final Escape 2.10 GmbH in Rostock.
