Contest Participation<\/h1>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t

1. Subject of the Terms and Conditions of Participation and Organizer<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

(1) These terms and conditions of participation govern the conditions for participating in one of our contests as well as any necessary transfers of rights.<\/p>

(2) The organizer of the contest is Final Escape HQ GmbH, Steinstr. 5, 10119 Berlin.<\/p>

(3) By participating in the respective contest, these terms and conditions of participation are accepted.<\/p>

(4) The contest is not affiliated with META in any way; it is neither sponsored, endorsed, nor organized by META. META is also not available as a point of contact for the contest.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

2. Participation\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

(1) Everyone who has reached the age of 18 and is resident in Germany is eligible to participate in the contest. Excluded are employees of Final Escape HQ GmbH, affiliated companies, as well as family members of such employees and their relatives. Participation using fake identities or the identities of third parties is not permitted.<\/p>

(2) Eligible participants can take part in the contest by fulfilling the requirements stated in the contest post.<\/p>

(3) The deadline for participation will also be communicated in the respective post.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t

3. Prizes and Winner Notification\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

(1) The prizes will be announced in the contest post.<\/span><\/p>

(2) The winners will be determined at random within a maximum of three days after the participation deadline, from among all eligible participants who have met the participation requirements. The winners will be notified via direct message and asked to provide booking details (first name, last name, email, and phone number), submitting their personal data completely, accurately, and truthfully. This information is used to send the prize.<\/span><\/p>

(3) If no response is received from a winner within the specified period, the claim to the prize lapses. In such a case, a new winner will be determined at random.<\/span><\/p>

(4) Only one prize is possible per participant, and the prize may neither be transferred, exchanged, nor paid out in cash.<\/span><\/p>

(5) If the prizes are sent to the winner by mail to the address provided, the risk of transport passes to the winner upon handover of the prize to a delivery person. We are not responsible for shipping damage.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

4. Grant of Usage Rights\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

(1) If participation in the contest requires submitting photos, the participant guarantees that they hold the necessary rights to the uploaded or linked photo. If the participant is not the sole author or rights holder, they expressly declare that they possess the rights required for participation in the contest.<\/span><\/p>

(2) Furthermore, the participant grants us the following simple, non-exclusive usage rights to the photo they used, unlimited in time and place:<\/span><\/p>

  • the right to store the photo;<\/span><\/li>
  • the right to make the photo available to the public, in whole or in part, via META and our websites (in particular https:\/\/www.final-escape.com\/);<\/span><\/li>
  • the right to use the photo to promote our products, which includes, but is not limited to, using the photo on our website for external presentation;<\/span><\/li>
  • the right to edit the photo, provided that the image is not distorted.<\/span><\/li><\/ul>

    <\/p>

    (3) When using the image, we will credit the author appropriately, to the extent feasible given the specific form of use.<\/span><\/p>

    (4) By accepting the prize, the winner agrees that we may use their name for promotional purposes. Wherever possible, we will not use the winner’s full name in doing so.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    5. Liability and Indemnification\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    (1) If the participant uploads photos, they guarantee that they will not submit any content whose provision, publication, or use violates applicable law or the rights of third parties.<\/span><\/p>

    (2) The participant shall indemnify us against any third-party claims of any kind arising from the unlawfulness of photos used by the participant. This indemnification obligation also includes the obligation to fully indemnify the organizer against legal defense costs (e.g., court and attorney fees).<\/span><\/p>

    (3) By participating in the contest, the participant releases META from any liability.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    6. Exclusion\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    (1) A violation of these terms and conditions of participation entitles us to exclude the respective participant from the contest. This applies in particular if the participant provides false information or if photos or other content used (e.g., comments) violate applicable law or the rights of third parties. The same applies to comments that may be regarded as glorifying violence, offensive, harassing, or demeaning, or that otherwise violate generally accepted standards of decency.<\/span><\/p>

    (2) If the excluded participant is a winner who has already been drawn, the prize may be revoked retroactively.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    7. Early Termination and Amendments\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    We reserve the right to terminate the contest early, in whole or in part, or to modify it during its course at any time and without prior notice, if it is not possible to guarantee the proper execution of the contest due to technical reasons (e.g., computer virus, manipulation of or errors in software\/hardware) or legal reasons (e.g., prohibition by META).<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    8. Data Protection\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    We are responsible for the collection, processing, and use of participants’ personal data, insofar as we process it ourselves. We will only use the participant’s personal information and other personal data within the scope of the applicable data protection laws. We will only store, process, and use the information to the extent necessary for conducting the contest or to the extent that the participant has given consent. This also includes use for exercising the granted usage rights.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    9. Final Provisions\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    (1) Should the terms and conditions of participation contain any invalid provisions, the validity of the remaining conditions shall remain unaffected.<\/span><\/p>
